A senior surgeon in New Caledonia jailed for 20 years for homicide has failed in his bid to get his appeal court hearing transferred to another jurisdiction.
This follows last week's unsuccessful attempt to be released pending his appeal court appearance.
Olivier Peres, who oversaw the orthopaedic department at Noumea's public hospital, shot dead his neighbour Eric Martinez on a golf course four years ago.
The defence said the conditions in Noumea's prison were unworthy, affecting Peres' health, and therefore he should be allowed to leave the jail.
But the judges ruled that awaiting his appeal court appearance he would have to remain in prison because there was a flight risk.
The case is expected to be heard later this year.
In March, he was convicted in a week-long jury trial in the criminal court attended by more than two dozen witnesses and experts.
The prosecution sought an 18-year sentence, but the verdict was for 20 years imprisonment for the premeditated killing of Martinez.
Peres had denied any intention to kill him, saying he acted in self-defence.
Peres fired a third shot from close range, claiming he did so as not be killed by Martinez, who was later found to have a knife in his pocket.
