A woman dubbed the 'Black Widow' may have to go to the High Court to get body samples of her dead husband released for testing in Australia.
Helen Milner is serving a 17-year jail sentence for poisoning Philip Nisbet with anti-allergy drugs in 2009.
Mr Nisbet's death was initially treated as a suicide, but the case was reopened in 2011 after an investigation by his sister, Lee-Anne Cartier, and an inquest.
Milner wants samples of Mr Nisbet's blood, urine, liver and hair to be released for testing - in a last ditch effort to overturn her conviction.
However at the Court of Appeal on Wednesday, the Crown made a late submission that the proper jurisdiction to hear the case is the High Court.
Outside court, Lee-Anne Cartier, told reporters she wants the whole thing to come to an end.
