On Friday the government announced Meng Foon had failed to adequately declare conflicts of interest including $2 million worth of government emergency housing payments to his company.
The Associate Minister of Justice said she probably would have sacked him, if he hadn't already offered his resignation.
However Meng Foon is adamant he declared all his conflicts of interests before taking up the job of Race Relations Commissioner and he hasn't formally resigned.
