The case revolves around last January's jailing of 27-year-old Polish man Norbert Wloszczinsky for being part of a yacht crew caught with more than 600 kilograms of cocaine.

The lawyer Barbara Brunard said pending the appeal, her client could legally only be held for four months and should therefore have been freed on 22 May.

The complaint also concerned the prison's deputy director.

The other two men arrested over the same cocaine smuggling incident also claim to be held arbitrarily.

Their case is due to be heard in the appeal court on Tuesday.
