The developer behind Waiheke Island's Kennedy Point Marina says their construction work is not preventing korora - Little Blue Penguin - from swimming out of their nests.
Forest & Bird wrote to Auckland Council on Friday demanding work near the penguins nests be stopped immediately.
But the developer says it's working on a plan with a leading seabird ecologist, and it's yet to be given to the council for final approval.
